1. Compliance With Laws

You are solely responsible for complying with all applicable local, state, federal, and international laws, regulations, ordinances, and governmental requirements relating to the purchase, possession, operation, transport, and use of Xpece products.

2. FAA and Safe Flight Responsibility

You are solely responsible for understanding and complying with all aviation requirements applicable to your operations, including registration requirements, Remote ID obligations, airspace restrictions, temporary flight restrictions, waivers, permits, licensing, and any other operational rules that may apply in your jurisdiction.

3. Lawful Use Only

Xpece products may not be used for any unlawful, fraudulent, reckless, dangerous, or unauthorized purpose. You agree not to use the products to violate the rights of others or to facilitate criminal activity.

4. Prohibited Activities

Without limitation, you agree not to use Xpece products:

• To transport illegal items.

• To harass, stalk, intimidate, or invade another person's privacy.

• To conduct unauthorized surveillance.

• To damage property or endanger people or animals.

• To interfere with emergency services or public infrastructure.

• In any manner prohibited by applicable law or regulation.

• Violate any law.

5. Restricted Airspace and Locations

You are responsible for determining whether a flight is authorized before takeoff. Xpece does not guarantee that any location is legal or safe for drone operation.

6. Pre-Flight Responsibility

You are responsible for inspecting your drone, batteries, payloads, firmware, GPS reception, weather conditions, and surrounding environment before each flight.

7. Assumption of Risk

Drone operation involves inherent risks, including crashes, flyaways, signal interference, GPS degradation, battery failure, environmental hazards, equipment malfunction, property damage, personal injury, and total loss of the aircraft. You voluntarily assume all such risks.

8. No Guarantee of Performance

Environmental conditions including wind, weather, water, electromagnetic interference, magnetic interference, radio interference, wildlife, obstacles, software errors, satellite availability, or user error may affect performance. Xpece does not guarantee uninterrupted or error-free operation.

9. User Responsibility

You are solely responsible for all flights, decisions, actions, damages, injuries, fines, penalties, lawsuits, or governmental enforcement actions arising from your operation of the product.

10. Warranty Limitations

Any applicable warranty excludes damage caused by misuse, abuse, accidents, unauthorized modifications, improper maintenance, negligence, environmental conditions, improper storage, or operation outside recommended guidelines.

11. Unauthorized Modifications

Any unauthorized repair, modification, reverse engineering, or alteration may void warranty coverage and may affect product safety.

12. Third-Party Services

Xpece products or websites may integrate with third-party providers. Xpece is not responsible for their products, services, uptime, policies, or security practices.

13. Intellectual Property

All trademarks, logos, software, firmware, documentation, images, videos, designs, and content are owned by Xpece LLC or its licensors and may not be copied or used without authorization.

14. Privacy and Marketing Communications

By providing your contact information to Xpece, you acknowledge that Xpece may use your name, email address, telephone number, shipping information, and related account information to communicate with you regarding purchases, warranties, customer support, product updates, promotions, newsletters, marketing campaigns, abandoned carts, and other business communications where permitted by applicable law. Where required by law, marketing emails and SMS messages will be sent only with your consent, and recipients will be provided with applicable opt-out mechanisms.

15. Sharing Information With Third Parties

Xpece may share customer information with payment processors, shipping companies, fraud prevention providers, marketing platforms, analytics providers, technology vendors, warranty partners, customer service providers, and other business partners as reasonably necessary to operate its business or as described in its Privacy Policy.

Xpece may cooperate with law enforcement agencies, regulatory authorities, courts, and government entities. 18. Payment Defaults and Chargebacks

Customers remain responsible for all valid payment obligations. If a payment is declined, reversed, disputed in bad faith, or otherwise causes financial loss to Xpece, Xpece reserves the right to pursue all lawful remedies, including recovery of unpaid balances, collection costs, court costs, interest where permitted, and reasonable attorneys' fees where recoverable under applicable law or contract.

19. Right to Pursue Legal Action

Xpece reserves all legal and equitable remedies against individuals or entities that commit fraud, misuse payment methods, violate these terms, infringe intellectual property rights, or otherwise cause financial or reputational harm to Xpece.

20. Limitation of Liability

To the fullest extent permitted by law, Xpece shall not be liable for indirect, incidental, consequential, exemplary, punitive, or special damages, including loss of profits, business interruption, lost opportunities, loss of data, or loss of the aircraft, even if advised of the possibility of such damages.

21. Indemnification

You agree to defend, indemnify, and hold harmless Xpece LLC and its officers, employees, affiliates, contractors, successors, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from your purchase, possession, or use of Xpece products or your violation of applicable law.

22. Right to Refuse Service

Xpece reserves the right to refuse service, reject transactions, cancel orders, terminate accounts, or discontinue relationships with customers for any lawful reason.

23. Product and Policy Changes

Specifications, pricing, availability, firmware, software, documentation, website content, warranties, and company policies may be changed at any time without prior notice.

24. Governing Law and Venue

To the maximum extent permitted by law, any dispute arising from your purchase or use of Xpece products shall be governed by the laws designated in Xpece's Terms of Service, and any legal proceedings shall be brought in the courts specified therein unless otherwise required by applicable law.

25. Arbitration and Class Action Waiver

Where permitted by applicable law and as set forth in Xpece's Terms of Service, disputes may be resolved through binding arbitration on an individual basis. You agree not to participate in class actions or representative proceedings except where prohibited by law.

To the fullest extent permitted by law, any claim arising from the purchase or use of Xpece products must be brought within the applicable contractual or statutory limitation period, or it may be permanently barred.

Customers are responsible for complying with all applicable export control laws, sanctions, and trade restrictions when purchasing, shipping, or using Xpece products internationally.

28. Severability

If any provision of this Legal Notice is found invalid or unenforceable, the remaining provisions shall remain fully effective.
